Nurture Genetics LLC - Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the genetic counseling services ("Services") provided by Nurture Genetics LLC ("Nurture Genetics," "we," "us," or "our"). By accessing or using our Services, you ("you," "user," or "client") agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Services Provided

Nurture Genetics LLC provides genetic counseling services, which may include, but are not limited to:

Reviewing family and medical history to assess risk for genetic conditions.
Discussing inheritance patterns and recurrence risks.
Explaining genetic testing options and interpreting test results.
Providing information about management and treatment options for genetic conditions.
Offering emotional support and counseling related to genetic concerns.
Connecting clients with relevant resources and support groups.

2. Geographic Scope

Nurture Genetics LLC provides Services to clients located in the following jurisdictions: United States, Canada, European Union, United Kingdom, Australia, New Zealand, and Euroasia. We comply with the relevant laws and regulations of each jurisdiction where we operate.

3. User Rights and Responsibilities

3.1. User Rights:

Right to Information: You have the right to receive clear and accurate information about our Services, including the benefits, limitations, and risks of genetic testing and counseling.
Right to Confidentiality: We are committed to protecting your privacy and maintaining the confidentiality of your personal and genetic information in accordance with applicable laws and ethical guidelines. Please refer to our Privacy Policy for more details.
Right to Informed Consent: You have the right to make informed decisions about genetic testing and counseling based on the information provided by Nurture Genetics.

3.2. User Responsibilities:

Provide Accurate Information: You are responsible for providing accurate and complete information about your family and medical history to the best of your knowledge.
Attend Appointments: You are responsible for attending scheduled appointments or providing sufficient notice if you need to reschedule or cancel.
Follow Recommendations: While we provide recommendations based on your individual circumstances, you are ultimately responsible for making your own healthcare decisions in consultation with your physician or other healthcare providers.
Respectful Communication: You agree to communicate with our staff in a respectful and professional manner.
Payment of Fees: You are responsible for paying all applicable fees for our Services as agreed upon.

4. Fees and Payment

Fees for our Services will be provided to you prior to the commencement of counseling.
Payment methods accepted will be specified on our website or communicated to you directly.
We reserve the right to modify our fees at any time, but we will provide you with reasonable notice of any changes.
Late payments may be subject to interest charges as permitted by law.
You are responsible for verifying whether our Services are covered by your insurance plan. We can provide necessary documentation for insurance claims, but we do not guarantee coverage.

5. Intellectual Property

All content and materials provided by Nurture Genetics, including but not limited to text, graphics, logos, and software, are the property of Nurture Genetics LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, modify, distribute, or create derivative works based on our content without our prior written consent.

6. Limitation of Liability

Nurture Genetics LLC provides genetic counseling services for informational and educational purposes only. Our Services are not a substitute for professional medical advice, diagnosis, or treatment.
We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of our Services, including but not limited to damages for loss of profits, data, or goodwill.
Our liability is limited to the amount you paid for our Services.
We are not responsible for the actions or omissions of any third-party healthcare providers or other professionals you may consult with.
We are not responsible for the accuracy or completeness of information provided by third parties, including but not limited to genetic testing laboratories.
While we strive to provide accurate and up-to-date information, genetic science is constantly evolving, and we cannot guarantee the accuracy or completeness of all information provided.

7. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis.
We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of our
Services for any particular purpose.
We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify and hold harmless Nurture Genetics LLC, its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising out of or related to your use of our Services, your violation of these Terms, or your violation of any rights of another party.

9. Dispute Resolution

Any dispute arising out of or relating to these Terms or our Services shall be resolved through good faith negotiation between the parties.
If the parties are unable to resolve the dispute through negotiation, either party may initiate mediation in accordance with the rules of the American Arbitration Association (or a similar organization in your jurisdiction). The mediation shall take place in Texas, unless otherwise agreed upon.
If mediation is unsuccessful, either party may initiate binding arbitration in accordance with the rules of the American Arbitration Association (or a similar organization in your jurisdiction). The arbitration shall take place in Texas, unless otherwise agreed upon. The arbitrator's decision shall be final and binding.
The prevailing party in any arbitration or legal proceeding shall be entitled to recover its reasonable attorneys' fees and costs.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. For users outside of Texas, USA, the laws of Texas, USA will still govern. You consent to jurisdiction in Texas for any legal dispute.

11. Termination

We may terminate your access to our Services at any time for any reason, including but not limited to your violation of these Terms.
You may terminate your use of our Services at any time by providing us with written notice.
Upon termination, you will no longer have access to our Services, and any outstanding fees will become immediately due and payable.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide you with reasonable notice of any changes by posting the updated Terms on our website or by sending you an email. Your continued use of our Services after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to expressing the intention of the original provision.

14. Entire Agreement

These Terms constitute the entire agreement between you and Nurture Genetics LLC regarding your use of our Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.

16. Force Majeure

Nurture Genetics LLC shall not be liable for any failure to perform its obligations under these Terms if such failure is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, epidemics, pandemics, government regulations, and internet outages.

17. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time without notice to you.

18. Waiver

No waiver of any provision of these Terms shall be effective unless it is in writing and signed by both parties. No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.

19. Electronic Communication

By using our Services, you consent to receive electronic communications from us, including emails, text messages, and notices posted on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

20. Compliance with Laws

However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information.
